Client terms & conditions.
What you can expect from Webver, and what we expect from you. Webver is a trading brand operated under Ecoboo Enterprise.
The one-minute version.
Monthly plans run month to month, and either side can stop with 30 days’ notice. Custom work is quoted and agreed in writing before it starts. Your domain is in your name and your content is yours — we never hold either hostage. Everything below is that, said carefully.
Both the English and Bahasa Malaysia versions are shown below. Turn on JavaScript to switch between them.
1. Who you are contracting with
Webver is a trading brand and service division operated under Ecoboo Enterprise, a business registered with the Companies Commission of Malaysia (SSM) under the Registration of Businesses Act 1956. Webver is not a separate incorporated company. The contractual relationship is between you and Ecoboo Enterprise, trading as Webver.

Invoices are issued in the name of Ecoboo Enterprise and quote that registration number. Payment is made only to the account printed on the invoice. If you ever receive bank details for us by any other route, stop and telephone the number above before paying anything.
2. What counts as the agreement
These terms, plus the written quotation or statement of work for your project, form the agreement. Only items expressly listed in that quotation are in scope. Anything else is additional work and is quoted separately before it is built.
3. How a project is accepted
By signing, confirming by email or message, paying the deposit, or telling us in writing to start. Any one of those is acceptance.
4. Fees and payment schedule
Unless the quotation says otherwise: 50% deposit before work begins, 50% before launch, transfer or handover. Larger projects may use a 40/40/20 structure. Payment is by bank transfer or DuitNow to the Ecoboo business account shown on the invoice — never to details sent to you any other way.
5. Deposits
The deposit secures our availability and lets work start. Once work has begun or non-recoverable costs have been incurred, deposits are non-refundable. If we have not started, we refund it in full. Nothing here excludes rights that cannot lawfully be excluded under Malaysian law.
6. Final payment and handover
Launch, transfer of files, administrative access, domain management and final credentials happen after the outstanding balance is settled. We may hold final delivery while payment is outstanding.
7. Late payment
Where payment is overdue we may suspend development, maintenance, launch or access to services we manage, and recover reasonable costs where permitted. Suspension moves the delivery timeline.
8. Timelines
We give an estimated delivery period. It is an estimate, not a contractual deadline, unless we agree one in writing. Timelines run from when we have your content — not from when you pay — and are affected by delayed feedback, approvals, third-party services and scope changes.
9. What you are responsible for
Accurate information, content and materials, account access where needed, timely feedback and approvals, and making sure the text, images and logos you give us can legally be used. Delays caused by these are not our delays.
10. Your content
You remain responsible for the accuracy and legality of what you supply — prices, claims, descriptions, testimonials, legal statements. We implement content; we do not verify every factual or legal claim inside it. For medical, financial, legal or regulated content, get professional advice.
11. Third-party materials
Fonts, icons, stock images, plugins, APIs, frameworks, hosting, analytics, maps and payment processors remain subject to their own licences and terms. We do not transfer ownership of third-party intellectual property, and some third-party licence or subscription fees may be payable by you.
12. Domain names
We recommend the domain is registered in your name, with you as the account holder, from day one. We will assist with registration, DNS, transfers and renewals. Domain fees are separate from development fees unless the quotation says otherwise, and we are not responsible for a domain expiring because renewal instructions or payment were not provided.
13. Hosting
Hosting is stated in the quotation and may be client-managed, Webver-managed or third-party. It is not automatically included in the development fee. Where we manage it, the fee, renewal period and included services are stated separately. Hosting may be suspended for overdue payment.
14. Maintenance
Development and maintenance are separate services. A monthly plan covers content updates, minor changes, monitoring, bug fixes, security updates and backups at the level of the plan chosen. Major redesigns, new features and substantial new functionality are new projects.
15. Bugs versus change requests
A bug is an agreed feature not working substantially as specified — we fix those within scope at no extra development fee. A change request is a new requirement, preference or design alteration that was not in the original specification — those may be charged.
16. Revisions
The number of included revision rounds is stated in your quotation. A revision is a reasonable modification to an agreed deliverable. A complete redesign, new page types, new functionality, new branding, or changes to something already approved may be additional work, quoted before it starts.
17. Approval
You are responsible for reviewing and approving deliverables. Approval by email or messaging app counts. Once a stage is approved, later changes to that stage may be additional work if they come from a change of preference rather than a genuine error.
18. Ownership — your materials
You keep ownership of everything you supply: logos, trademarks, brand assets, photographs, written content, product and business information. You grant us a limited licence to use them to build your project.
19. Ownership — our reusable systems
We keep ownership of our pre-existing intellectual property: frameworks, templates, component libraries, reusable code, internal tools, generic layouts and design systems, processes, know-how and documentation. Paying for a website does not transfer these.
20. Ownership — the project itself
On payment in full, you receive the completed website, its content and the rights needed to use it for your business, subject to third-party licences and to clause 19. Where the quotation provides for an express assignment of project-specific work, that assignment takes effect on full payment.
21. Showing your project as work
We may show a completed project in our portfolio — screenshots, a link, a general description, your business name — unless you tell us in writing beforehand that you would rather we did not. We will not disclose confidential information for portfolio purposes, and we label every project accurately as client work, in-house work or concept.
22. Personal data (PDPA)
Where a site collects personal data, you are normally the data user deciding why and how it is processed, and we are normally processing it on your behalf. You remain responsible for your own privacy notice, consent mechanisms and lawful purposes. We take reasonable measures appropriate to the services we provide. Malaysia's Personal Data Protection Act 2010, as amended by the Personal Data Protection (Amendment) Act 2024, applies to both of us. For the personal data we collect about you through this website and your enquiry, see our privacy notice.
23. Security
We take reasonable technical and organisational measures, but no internet-connected system can be guaranteed immune from hacking, malware, credential theft, third-party breaches, hosting failure or human error. You are responsible for keeping credentials we give you secure.
24. Backups
Unless backups are expressly included in your quotation or monthly plan, we do not guarantee that backups are kept. Where they are included, the frequency and retention are stated. Keep your own copies of critical information.
25. Third-party outages
We are not responsible for failures caused solely by hosting providers, registrars, payment processors, APIs, cloud or software providers, ISPs or platforms beyond our reasonable control. We will make reasonable efforts to help when they affect your project.
26. No guarantee of business results
We do not guarantee sales, revenue, profit, leads, search rankings, conversion rates or customer numbers. A website is a business tool and its commercial performance depends on many things outside our control. Where SEO work is included we perform the agreed work; search engines decide rankings.
27. Limitation of responsibility
We perform our services with reasonable care and skill. To the extent permitted by law, our liability for any claim is limited to the fees you have paid for the work in question, and we are not liable for indirect or consequential loss including lost profit. Nothing here excludes liability that cannot lawfully be excluded.
28. Confidentiality
Each side keeps the other's genuinely confidential information confidential, except where disclosure is required by law, needed to perform the project, already public, or permitted. We are happy to sign your NDA.
29. Ending a project
You may end a project in writing; work done to that point is payable and you receive those files. We may suspend or end a project for non-payment, repeated failure to provide what we need, unlawful requests, material breach or abusive conduct — with notice where practicable. Content or approvals stalling for more than 60 days is treated the same way. What comes back to you when a project or a monthly plan ends is set out in full in the refund and cancellation policy, which forms part of these terms.
30. Handover and migration
On full payment and completion we hand over website access, hosting and domain access, source files, documentation and credentials as set out in the quotation. If you later move to another provider we will help; migration work outside the agreed scope may be charged. We keep a copy for support, legal and accounting purposes.
31. Lawful use
You may not use a site we build for fraud, phishing, malware, copyright infringement, identity theft, unlawful surveillance or other unlawful activity. We may refuse or end services where we reasonably believe this is the intent, and will cooperate with lawful requests from authorities.
32. Independent provider
Engaging Webver does not create a partnership, joint venture, employment or agency relationship. We may engage freelancers, contractors or software providers where reasonably necessary, and remain responsible for managing the work.
33. Taxes and invoicing
You are responsible for taxes arising from your own business. We comply with applicable Malaysian tax and invoicing requirements, including e-Invoice requirements as and when they apply to us.
34. Governing law and disputes
Malaysian law governs these terms. If a dispute arises we will try direct discussion first, then a written dispute notice, then negotiation, before either side pursues formal remedies.
35. Changes to these terms
We may update these terms for future engagements. The version that applies to your project is the version in force when that project started, unless we both agree otherwise in writing.
36. Cancelling, and your ten-working-day cooling-off right
If we approached you first — a cold call, an unsolicited visit or message — and you then entered into a contract with us, you may cancel it within ten working days beginning the day after the contract was made, and receive back everything you have paid. This reflects the cooling-off right given by the Direct Sales and Anti-Pyramid Scheme Act 1993 to contracts formed through a direct approach, and we apply it to every such contract whether or not that Act strictly requires it in your case. It does not apply where you approached us.
Deposits, part-built work, monthly plans, digital assets and faulty work are all dealt with in the refund and cancellation policy.
37. Statutory rights we do not exclude
Nothing in these terms removes or limits any right you have under the Consumer Protection Act 1999, the Contracts Act 1950, the Sale of Goods Act 1957 or any other Malaysian law that cannot lawfully be excluded — including the implied guarantees that a service will be carried out with reasonable care and skill, will be reasonably fit for the purpose you made known to us, and will be completed in a reasonable time. Where any clause here would conflict with such a right, that right prevails and the clause is read down to the extent of the conflict.
38. Using this website
These terms also govern your use of webver7.vercel.app itself.
What the site is. It is information about a service. Prices shown are indicative starting points and ranges, not offers capable of acceptance and not quotations. A binding price exists only in a written quotation issued to you by name. Nothing on this site should be relied on as professional, legal, financial or technical advice for your particular situation.
The Showcase demonstrations. ARUS, Rumah Sambal, ARAS and SEMBILAN are fictional businesses invented for demonstration. Their names, addresses, telephone numbers, staff, menus, listings, prices and reviews are not real, are not offers, and do not describe any actual trading business. No booking, order or enquiry made inside a demonstration is transmitted anywhere or creates any obligation on anybody.
Live previews. Where this site can load another website into a preview frame, it does so only after you click to load it. Those sites belong to their owners and are governed by their own terms and privacy policies, not ours.
Our material. The design, code, written content, pixel icon set and brand marks on this site are owned by Ecoboo Enterprise and protected under the Copyright Act 1987. You may read, print and share links to these pages. You may not copy the site or substantial parts of it, scrape it in bulk, or present our work as your own. Client and partner names and marks belong to those businesses and are shown with permission.
What you must not do. Interfere with the site, attempt to gain unauthorised access to it or to anything connected to it, submit anything unlawful or malicious through its form, or use it to harass anybody. Doing so may be an offence under the Computer Crimes Act 1997 and the Communications and Multimedia Act 1998.
Availability. The site is provided as it is. We do not promise it will be uninterrupted or error-free, and we may change or withdraw any part of it.
39. Language
These terms are issued in English, with the essential commercial terms also published in Bahasa Malaysia on this page, and our privacy, cookie and refund policies published in full in both languages. Where a genuine conflict of meaning arises, the English text prevails, save where Malaysian law requires otherwise.
These terms are a working starting point for a small-business engagement and are not legal advice. For a substantial project both sides should have their own written agreement — we are happy to sign yours.
Nota.
